Welcome to Trekkr.life. These Terms of Use (the “Terms”) govern your access to and use of the Trekkr.life website and everything on it, including our field guides, the Adventure Builder, the marketplace and business directory, and the Adventure Passport membership (together, the “Service”). Please read them carefully.

1.Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

You must be the age of majority in your province, state or territory of residence to make a purchase or hold an account, or have the involvement of a parent or guardian who agrees to these Terms on your behalf.

2.About Trekkr and our Service

Trekkr.life is an overlanding and outdoor-recreation community. We publish trip content and field guides, operate a business directory and a gear marketplace, offer a trip-planning tool (the Adventure Builder), and sell an annual membership (the Adventure Passport). The Service is provided for general information, planning and community purposes.

3.Accounts and membership

Some features require an account or a paid Adventure Passport membership. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for activity under your account. Notify us at hello@trekkr.life if you believe your account has been used without your permission.

Membership billing, renewal and cancellation are described in our Refund & Cancellation Policy.

4.Purchases, pricing and payment

We sell digital field guides, business and marketplace listings, and Adventure Passport memberships. Prices are shown at checkout and may change over time. Applicable taxes may be added.

Payments are processed by our third-party payment provider, Stripe. By purchasing, you agree to Stripe’s terms. We do not collect or store your full card number. Field guides are delivered digitally (by download and/or email); memberships are recurring subscriptions. Refunds and cancellations are governed by our Refund & Cancellation Policy.

5.Marketplace and business listings

The Trekkr marketplace and business directory are venues that connect buyers, sellers and businesses. Any sale, booking or other transaction is directly between the buyer and the seller (or the business); Trekkr is not a party to it. We do not inspect, warrant or guarantee any item, business, price, description, or availability, and we are not responsible for the quality, safety, legality or completion of any transaction. Please use your own judgement and due diligence.

6.Advertisers and sponsors

Businesses that purchase listings, sponsorships or advertising are responsible for ensuring their content is accurate, lawful and not misleading, and that they own or are licensed to use everything they submit. We may review, edit, refuse or remove any listing or advertisement at our discretion. Sponsored and paid placements are identified as described in our Advertising & Affiliate Disclosure.

7.Your content and submissions

If you submit content to the Service — reviews, photos, rig or business submissions, or other material — you keep ownership of it, but you grant Trekkr a non-exclusive, worldwide, royalty-free licence to host, store, use, reproduce, adapt (including cropping and resizing), publish and display that content for the purpose of operating and promoting the Service across Trekkr.life, our emails and our social channels.

You represent that you have the rights to the content you submit and that it does not infringe anyone’s rights or break any law. Do not submit content that is unlawful, infringing, deceptive, or harmful.

8.Our intellectual property

The Trekkr name, logo, site design, written content, field guides, and Adventure Builder itineraries are owned by or licensed to Trekkr and are protected by intellectual-property laws. You may view and use them for your own personal, non-commercial purposes. Paid field guides are licensed to you for personal use; you may not redistribute, resell or publicly post them. You may not copy, scrape, republish or exploit our content without our permission.

9.Outdoor activities — assumption of risk

Outdoor recreation is inherently risky. Trail descriptions, campground details, drive-time estimates, seasonal notes and Adventure Builder itineraries are provided for general planning only. They may be incomplete, inaccurate or out of date, conditions change constantly, and they are not a substitute for current, official information and your own judgement.

You are solely responsible for your own safety and that of your party, including checking current conditions, closures, weather, fire bans and permits, carrying proper equipment, and travelling within your ability. You acknowledge and voluntarily assume all risks associated with any activity you undertake based on information from the Service.

10.Disclaimers

The Service and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure.

11.Limitation of liability

To the fullest extent permitted by applicable law, Trekkr and the people who run it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage, arising out of or related to your use of (or inability to use) the Service, the field guides, itineraries, listings, or any third-party business. Where liability cannot be excluded, our total liability is limited to the amount you paid us, if any, for the item giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

12.Indemnification

You agree to indemnify and hold harmless Trekkr from any claims, losses or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.

13.Third-party links and services

The Service links to and relies on third parties (for example, Stripe for payments and the businesses in our directory). We are not responsible for the content, products, or practices of third-party sites or services, and your dealings with them are governed by their own terms.

14.Suspension and termination

We may suspend or terminate your access to the Service, or remove content, at any time if you breach these Terms or to protect the Service or other users. You may stop using the Service at any time; provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability and indemnification) will survive.

15.Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Effective date” above and post the updated version here. Your continued use of the Service after changes take effect means you accept the updated Terms.

16.Governing law

Prices and currency. All prices on Trekkr.life are stated and charged in United States dollars (USD), including field guides and the Adventure Passport. If your card is issued in another currency, your bank or card issuer converts the amount at their own rate and may add a foreign-transaction fee — that conversion and any such fee are between you and them, and are not amounts we receive or control.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in that province for any dispute, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.
